Software End User License Agreement.

The terms stated below may be superseded/replaced by the agreement accepted when installing products obtained on this website. COPYRIGHT. All products created by Fieldston Software, LLC. (the Software) are owned by Fieldston Software, Inc. and are protected by United States copyright laws and treaty provisions. By purchasing this software, you are agreeing to be bound by the terms of this license. If you do not agree with this license, you may return all materials to Fieldston Software within 15 days for a full refund.

GRANT OF LICENSE

With your purchase of the Software, Fieldston Software grants you the right to install and use the program on the specific number of computers equal to the number of licenses purchased. You may install the Software on multiple computers, or use it with multiple organizers, provided that each installation is covered by the number of licenses purchased (e.g. 3 licenses can be used on three computers).

RIGHT OF REFUSAL

Fieldston Software reserves the right to grant a license to the Software at their sole discretion. Fieldston Software, LLC. values our staff and will only accept civil language in telephone and email communications. Use of profane language will result in termination of your license and any obligation for further support or assistance by Fieldston Software.

ANTI-HARASSMENT

Use of profane language, acronyms that indicate profanity, anger, excessive loudness, or threats in telephone calls, emails, or any other medium, whether or not directed towards Fieldston Software, to any Fieldston Software employee, will be considered grounds to terminate your license. The determination will be made at Fieldston Software's sole discretion. If your license is terminated for harassment, Fieldston Software will not re-license the Software until you designate a polite adult party for all future communication, including all telephone calls and emails, on your behalf, and re-purchase the license.

RESTRICTIONS

You may not make copies of any documentation, web pages, or any written material copyright by Fieldston Software without written permission from Fieldston Software. You may not decompile or reverse engineer the Software.

GOVERNING LAW. The laws of the State of New York govern this license agreement.

RIGHTS. Fieldston Software retains all rights not expressly granted. Nothing in this license agreement constitutes a waiver of Fieldston Software's rights under U.S. Copyright laws or any other Federal or State law.

LIMITED WARRANTY

Fieldston Software warrants that the Software will perform substantially in accordance with the accompanying written materials for a period of 30 days from the date of receipt. Any implied warranties on the software are limited to 30 days. Some states do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.

CUSTOMER REMEDIES

Fieldston Software's entire liability and your exclusive remedy shall be, at Fieldston Software's option, either (a) return of the price paid or (b) repair or replacement of the software. This Limited Warranty is void if failure of the software has resulted from accident, abuse, or misapplication. Any replacement software will be warranted for the remainder of the original warranty period or 30 days, whichever is longer.

NO OTHER WARRANTIES

FIELDSTON SOFTWARE DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIALS. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL FIELDSTON SOFTWARE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, SPECIAL, INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION,

LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS PRODUCT, EVEN IF FIELDSTON SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
